B2 Overstay

Hi! My husband came on a B2 visa. It expires in April and while we are trying to get everything filed before his stay expires in April we are having difficulty with getting his birth certificate so it might take longer than we hoped. My question is after his stay expires can we still file the AOS? If so, is he no longer subject to being deported once the application is received or since it was after his overstay will he be at risk until it is approved or denied? I am a US Citizen by birth. Thank you in advance!

I-864 Income Requirements

Hello! I am currently starting the AOS and Spousal Visa for my Husband. We had a baby last year and I was considered high risk so I was off of work on maternity leave for almost a year. While I have since returned, my 2023 taxes does not meet the requirement by almost $900. I have a 401K and I do make my rate from my 2022 taxes now. Will this be an issue? Or if I provide my previous year and pay stubs or VOE letter will that suffice? And if they declare I do NOT meet the income requirements do I we get a chance to add a joint sponsor or is it just denied?

Concurrent I-130 and I129F

Good morning VJ,

My spouse came across a forum discussion suggesting that the I130 process can be expedited by submitting the I129F (K3) after the I130 has been filed. Is this approach still effective nowadays? What is your opinion on this strategy?

Do you recommend sending the I129F immediately (The next day) after receiving the Form I-797 Notice of Action receipt from USCIS?

The USCIS portal offers scant information regarding the prerequisites for the K3 procedure, aside from completing Form I129K. While exploring on the internet, I stumbled upon some additional details. Do you think these details are the requirements to send along with your I129F form?

Thanks in advance.

Welcome and Congratulations on your approval!

This thread was created for those who are waiting for their NOA2 K-1 case assignment from NVC and then tracking your case onwards to your Embassy.

A few helpful NVC links:

NVC phone number is (603)334-0888

Please note: They are currently NOT answering queries over the phone!

They are answering through the below emails :

NVCinquiry@state.gov

OR

NVCResearch@state.gov

Once you ve received your NVC case number you can track your case online using the following link, until it is sent to your embassy:

https://ceac.state.gov/CEACStatTracker/Status.aspx?App=IV

If you need to submit an inquiry, change an address , or need to update your info in anyway NVC also has a public inquiry form where you can submit your request as well as other requests:

https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/ask-nvc.html

Also, inside the attached PDF below are a few tips, tricks and hacks to help you along the way.

These are items that everyone asks for, so they have been very helpfully put together by senior VJ Member Greenbaum for you to refer to when necessary. If you are new to this thread, please read these first as these are the most asked questions.

NVC sends petitions to the embassy every two weeks on Tuesdays and Wednesdays. I noticed a 2024 shipping calendar being shared so I have included it below.

You can use that calendar to track when the next shipment date will be.

Hello !

My son finally received the notice that its petition is awaiting an interview appointment and that the case will remain at the NV until an appointment is scheduled and that they will notify when an appointment is scheduled

i remember WITH MY CASE years ago that there was no email notification, but a mail sent to my address, that was all.

My son want to move to another country for 5 months irn order to finish some studies and works (he works and study online) but he and i, we are afraid to miss any notification, we would be relying on online notification solely.

The previous notification of waiting for visa interview was on February 10th this year, he is going abroad next April 8th, have anyone any idea when would we expect the next step? any notification or whatever?
